State arbitration laws do not govern in any respect.
This arbitration agreement is intended to be broadly interpreted, and will survive termination of these Terms. The arbitrator, and not any federal, state or local court or agency, shall have exclusive authority to the extent permitted by law to resolve all disputes arising out of or relating to the interpretation, applicability, enforceability or formation of this Agreement, including, but not limited to any claim that all or any part of this Agreement is void or voidable. There is no judge or jury in arbitration, and court review of an arbitration award is limited. The stages are magnificent, moving parts and intricate designs. They know how to give a good light show (only the giant stage kind of course, because gloves are banded at their events) complete with fire and tons of color. They have cool art pieces and costumed clowns that walk through the crowds – my personal favorite being the giant octopus. Every event grants an escape from reality and brings you into a whole other carnival world, it’ll dazzle your mind. But there are some issues I have with Insomniac. One, is that many of the events seem to be focused so much on escaping reality that people also leave their responsibility behind. After the crowds clear at Insomniac events, grounds are left destroyed with trash – the worst left behind trash piles I have seen at any festival I have been too. In general, Insomniac events seem to be focusing more and more on how big they can be without always taking advantage of the responsibility that impact can have. Also, although all the events prove amazing, every year tends to bring you the same type of thing – repeated themes, art pieces, general concepts. You know what to expect – which is comforting in some ways, but also limiting. Personally, I’ve steered away from Insomniac Events this year simply because they overlap with other events (Audio on the Bay the same weekend as Lightning in a Bottle, Nocturnal Wonderland the same weekend as Burning Man, Beyond Wonderland the same weekend as Life is Beautiful) and once you’ve seen Insomniac happen, well.. you’ve seen it. Overall, Insomniac provides high production events that you can to escape your reality for a night – or a weekend – and dance your little heart free, but it is but only a piece of what the world of festivals and raves has to offer. Use it as a starting point, or place to return home to, but let’s not assume it’s the only group producing amazing events. Here’s some advice in general, for attending Insomniac Events: Crowds: I promise you, dancing through the crowd is WAY easier than shoving your way through it. Shake a hand, offer a hug, a piece of gum, a dance move, a smile. Exchange something for someone’s spot in a crowd. Water Stations: Free water stations are at every event. Most events you can bring in any water bottle as long as it’s empty, others you can bring just Insomniac tin bottles ($10 inside). Camel packs are always allowed. Water stations are most crowded in between sets. Make sure your bottles are out when you get to the front of the line, makes it faster for everyone. If your water seems fuzzy, shake it – it’s because of the pressure coming out the hose, not because it’s dirty. ADA (American Disabilities Act): The ADA booth, usually near the entrance information booths, can help you with any questions on this – but basically they give you a wristband that’ll help with access to specific bathrooms, platforms, parking, and entrance. Most of the things they might take from you at the entrance are going to be there. Also, first-aid is free (you’ll have to fill out paperwork obviously), so don’t be afraid to go there because dying isn’t worth it. Also, if your friend is dehydrated/sick/having a bad time – TAKE THEM TO MED. It’s so much better for them to sober and heal up on a bed with an AC than out in a crowd, plus you can go enjoy the event while knowing they’re in a safe haven. Insomniac has an absolutely amazing medical team that is equip and ready to help you, let them. Tickets: Tickets aren’t refundable. They say that on almost any event. So know before you buy them… they aren’t refundable. You can probably sell them to someone on the event pages because most events end up selling out anyways. Payment info was always up to date, I had confirmation emails sent to me with processed payments and then out of nowhere a refund is applied to my purchase. I transferred to 2022 but then they apparently sent a follow up email that I had to respond to in order to confirm the May dates that I didn’t see. That’s not right that it didn’t change automatically just because they added new dates AFTER I already requested a transfer. I wanted May but now I have tickets for October that I can’t even use. I was on a layaway plan and was told I needed to pay off the ticket (the women on the phone for their 3rd party operators mentioned) or they would keep a portion of the ticket price stating I signed the contracts. I asked her if there was anything in the contracts about pandemics and she quietly said no. I ended up paying off the ticket and was told I would get my refund in three days (yes I went through the steps on the email and on their website to submit my refund). It’s been over three days now and I called the third party operator back asking for confirmation that my refund was on it’s way. They operator said I wouldn’t need to call Insomniac directly, so I did. No one picked up the phone and it’s 3pm on a Tuesday.
